Upaya Komisi Pemilihan Umum Dalam Pemenuhan Hak Konstitusional Penyandang Disabilitas Pada Pemilihan Umum Di Kota Gorontalo

Abstract

The right to vote is one of the constitutional rights guaranteed by Article 28D of the 1945 Republic of Indonesia Law and enhanced by Article 43 paragraph (1) of Law Number 39 of 1999 concerning Human Rights. In the 2019 General Election there were 437 data on disabled voters, consisting of 239 men and 198 women. Then there were 349 people who exercised their right to vote with disabilities, consisting of 168 men and 181 women. However, there are still 88 voters with disabilities who do not exercise their right to vote in the 2019 General Election. So that the constitutional rights of persons with disabilities are not fulfilled can be one of the factors in not fulfilling the overall vote acquisition in the implementation of general elections. So that the formulation of the problem in this research is how the efforts of the General Election Commission in fulfilling the constitutional rights of persons with disabilities in general elections in the City of Gorontalo. The research objective is to examine the efforts of the General Election Commission in fulfilling the constitutional rights of persons with disabilities in the City of Gorontalo. This research method is empirical research using an empirical juridical approach. The results of this study indicate that the General Election Commission ensures that voters with disabilities who meet the requirements are registered as voters and guarantee the availability of supporting facilities and infrastructure for voters with disabilities to grant their right to vote accompanied by political education by democracy volunteers.
