Peran Pemerintah Dalam Memberikan Kepastian Hukum Bagi Masyarakat Suku Bajo Di Desa Torosiaje Laut

Abstract

The purpose of law that is close to reality is legal certainty, legal certainty is something that must be provided by every Indonesian citizen so that legal relations between people, including legal entities, with earth, water and space and authorities derived from legal relations, this paper aims to determine the role of local governments in providing legal certainty to the Bajo tribal community in Torosiaje Laut village related to the right to a house or  the building they occupy.  The research method used is normative legal research where the problems studied are studied and analyzed based on statutory provisions, books, articles and various journals. The result obtained is that the house or building they occupy does not have legal certainty, this is because the BPN Pohuwato office has not issued a certificate because there are no regulations or local regulations for the Bajo tribe community related to land ownership and there is also no permit from the marine service related to mortgage rules for houses or buildings in Torosiaje Laut Village. To overcome the problem in providing legal certainty to the Bajo tribe community related to houses or buildings on the sea to the Bajo tribal community by him, the local government in this case the Pohuwato Regency DPRD should have issued a Regional Regulation related to the use of sea areas for residential areas, and also the marine service provides permits and regulates the area of KPR settlers so that BPN Pohuwato can issue a certificate of right to use for the Bajo Tribe community in the village  Torosiaje Sea.
